Hillingdon Arms pub fined over noise problems

THE licensee of a Hillingdon pub has been fined more than £2,000 after being found guilty of causing a noise nuisance after investigation by Hillingdon Council.

The Hillingdon Arms pub, in Sutton Court Road, Hillingdon, was first reported to the council’s Noise Team in May 2008 when neighbours complained about loud music at the pub.

Officers visited the pub and witnessed a nuisance and issued the pub with verbal and written warnings to the licensee Margaret O’Shea and the designated premises supervisor Collette Phillips.

In November 2008 a further nuisance was witnessed and a Noise Abatement Notice was issued. This was breached in February 2009 and legal action was started. The case went to court in October for a hearing where Ms Phillips pleaded not guilty to the charges. Mrs O’Shea pleaded guilty and was fined £500, ordered to pay £781 costs and a £15 surcharge.

Ms Phillips appeared in court on 29 January and was fined £300, ordered to pay costs of £600 and a £15 victim surcharge. They now both have a criminal record and the pub has had to pay a total of £2,210 for playing loud music that was a nuisance to neighbours and have been informed by the court that any further witnessing of noise nuisance will result in a stiffer penalty being imposed.

Three residents were also sentenced for causing a noise nuisance, with Samantha Nicholson and Etienne Codrington of Cromwell Road, Hayes, given a conditional discharge and both were ordered to pay £100 costs.

Lucy Ayris, 20, of Portal Close, Uxbridge, was fined £50 and ordered to pay £50 costs and a victim surcharge of £15 for breaching a Noise Abatement Noise by playing loud music in the premises.

Kathy Sparks, Deputy Director of Environment and Consumer Protection, said: “This type of behaviour will not be tolerated and Hillingdon Council will always look to take action against those who cause a noise nuisance and continue to ignore warnings.”
